The Terms & Conditions of Sale of Mautassin form the basis of our commitment to you. They clearly outline the procedures for payments, deliveries, returns, and product customization. By reviewing them, you gain transparent insight into every step of your purchasing experience.

 

Préambule

These Terms & Conditions are entered into between:

  • Mautassin Haute Couture, a Moroccan limited liability company with capital of 5,000,000.00 dirhams, headquartered at 72 Boulevard Al Massira Al Khadra, Racine, Maarif, Casablanca, Morocco; registered under no. 263507 in the Casablanca Trade Register, Tax ID no. 14366060.

Hereinafter referred to as “Mautassin Haute Couture” or “Mautassin.”

And

  • Any individual or legal entity wishing to make a purchase through Mautassin Haute Couture’s e-commerce website at https://mautassin.com, hereinafter referred to as “the User.”

Collectively, Mautassin and the User are referred to as the “Parties” and individually as a “Party.” A User who validates an order is designated the “Buyer.” The rights and obligations of the User automatically apply to the Buyer.

To place an order for the high-couture traditional clothing offered online, the User must have full legal capacity or obtain authorization from a parent, guardian, or curator.

Placing an order for a product offered on the site implies express acceptance of these Terms & Conditions, without requiring a handwritten signature.

Regarding electronic signatures, validation of the order form as described below constitutes an electronic signature, which has the same value as a handwritten signature between the Parties, and constitutes full proof of the order and the amounts due.

These Terms & Conditions apply, without restriction, to all sales concluded by Mautassin Haute Couture with non-professional Buyers acquiring online products.

They are accessible at any time on the Site and prevail over any other version or conflicting document.

Unless proven otherwise, records maintained by Mautassin Haute Couture serve as proof of all transactions.

Access to the Site requires a standard Internet connection; no connection surcharges will be billed to the User.

These Terms & Conditions may be updated; the version in effect on the date of order placement applies.

Article 1. Purpose

 

These Terms & Conditions clearly define the rights and obligations of all Parties in the context of online commercial relations. They cover all stages, from order placement to tracking.

The Parties agree that their interactions are governed exclusively by these terms. Any missing provisions are governed by standard practice in the Moroccan remote selling sector.

 

Article 2. Products – Prices

2.1. Products

 

Products listed on the Site may be purchased while stocks last.

If an item becomes unavailable after purchase due to stock depletion, the Buyer will be notified by email as soon as Mautassin’s logistics are updated. The unavailable item will be cancelled and refunded, while the remainder of the order stays valid and final.

 

2.2. Product Information

Each product page provides an essential description of the item. We strive to provide complete information to help Users make informed choices before purchasing.

However, Mautassin cannot be held liable for errors or omissions in descriptions. Photos and descriptions are indicative only and not contractual; color variations may occur due to different browsers or screen resolutions.

If you notice any errors, please contact Customer Service at mautassin.hautecouture@gmail.com or info@mautassin.com. We will correct any inaccuracies promptly.

 

2.3. Prices

Prices are shown in Moroccan dirhams (MAD), including all taxes, including VAT, on the day of purchase. You may choose another currency at checkout.

Prices apply while stock lasts and are subject to change due to material costs, tax changes, or typographical errors. Shipping costs are separate and depend on the delivery destination.

Mautassin reserves the right to update prices at any time, but orders are billed at the price at the time of placement, subject to product availability.

We strive for pricing accuracy; if an error is detected, we will contact you immediately to cancel or confirm the order at the correct price. If we cannot reach you, the order will be cancelled and refunded.

 

Article 3. Order Registration and Validation

3.1. Browsing the Site

 

Users may freely browse Mautassin’s Site without obligation to purchase.

 

3.2. Registration and Password

To place an order, registration is required:

  1. Account creation: Enter an email and password. A confirmation email will follow.

  2. Account activation: Log in and complete personal information (name, phone, email). Measurements are optional.

Your password is encrypted; you’re responsible for maintaining its confidentiality. Forgotten passwords can be reset via “Forgot Password?”

You may opt to receive emails about promotions and newsletters during registration.

 

3.3. Order Recording

Ordering Process on the Mautassin Website

To place an order, the user must be connected to the Internet and browse the Mautassin website. Each order must include all necessary information for processing and implies acceptance of the Terms & Conditions of Sale, as well as the prices and product descriptions available.

Steps to place an order:

  1. Product Selection: The user selects the desired products and adds them to the cart by clicking on "Add to Cart."

  2. Cart Management: At any time, the user can:

    • View a summary of selected items by clicking on “My Cart”;
    • Continue shopping by clicking on “Continue Shopping”;
    • Finalize the selection and proceed to payment by clicking on “Checkout.”
  3. Identification and Order Information: To complete the order, the user must identify themselves:

    • If already registered, by entering their email and password;
    • If not registered, by filling out the sign-up form available via “My Account” at the top of the homepage.

Logging in with these credentials confirms the user's identity and their acceptance of the terms of sale.

  1. Order Finalization: Once identified, the user can fill in the shipping details and any other required information. A summary of the order is then displayed on-screen, indicating the product type, quantity, and price, shipping fees, the total order amount, as well as the user’s contact details and delivery address.

Note: Mautassin cannot combine multiple unshipped orders into a single shipment.

 

3.4. Final Order Confirmation

Order Finalization and Payment

Once you have reviewed the details of your order and completed all required information, you can finalize your purchase by clicking on “Checkout”.

Payment Procedure by Credit Card:

To pay by credit card, you will need to provide the following information:

  • The cardholder’s name
  • The credit card number
  • The expiration date
  • The security code (3-digit CVV located on the back of the card)

Once these details are validated, your payment is securely processed, and the order is irrevocably recorded. At this stage, your status changes from User to Buyer. The order confirmation is stored in Mautassin’s digital records, securely kept as proof of the contractual relationship.

 

3.5. Order Confirmation

Order Confirmation and Email Receipt

After your credit card payment has been validated—including details such as the card number, expiration date, and security code on the back—a detailed summary of your order will be sent to the email address you provided during checkout. This confirmation email will include all elements of the contract established between you and Mautassin, including an estimated shipping date for your order.

Keeping the Order Confirmation:

Mautassin recommends that you keep this confirmation email, either by saving it electronically or printing it out, as proof of your purchase. Documents stored in Mautassin’s digital systems are considered legal evidence of the transaction. You can also access a summary of your order at any time from your customer account.

 

Article 4. Payment

4.1. Order Amount

 

The amount due by the Buyer is shown before the User confirms the order, as well as in the order confirmation email sent by Mautassin to the Buyer.

The User must pay the full amount at the time of placing the order. No reservations are possible.

 

4.3. Payment Confirmation

Payment must be made, unless the server is unavailable, immediately online by a payment card issued in Morocco or by an international card such as Visa or Mastercard.

 

4.3. Confirmation de paiement

The order will be considered valid only after confirmation of the bank payment authorization. If the payment is refused by the CMI, the order will be automatically canceled. In any case, Mautassin reserves the right to refuse any order or delivery in the following situations: I) an ongoing dispute with the Buyer, II) total or partial non-payment of a previous order by the Buyer, III) refusal of payment authorization by banking institutions, IV) non-payment or partial payment. Mautassin cannot be held liable in such cases.

 

4.4. Payment Timeline

When the Buyer pays with an immediate debit card, the Buyer’s bank account is debited within 2 to 5 days after placing the order. This timeframe depends on the bank. In the case of a deferred debit card, the Buyer’s account will be debited under the same conditions as their usual debit terms.

 

4.5. Exceptional Conditions

Mautassin has implemented a verification procedure to prevent fraudulent use of bank details for placing orders on its website. As part of this verification, the customer will be required to send Mautassin (by mail) a copy of both sides of their ID card and a proof of address dated within the last 3 months. The order will only be shipped after receipt and verification of the requested documents. Mautassin reserves the right to refund the order if the documents are not received or are found to be non-compliant.

Only customers whose order exceeds a certain amount defined by Mautassin will be required to provide these documents. After placing the order, the concerned Buyer will receive an email from Mautassin’s Customer Service requesting the necessary documents.

 

Article 5. Delivery

5.1. Shipping Timeframe

 

The shipping timeframe of an order is indicative and starts from the day following the Buyer’s confirmation of their order.

This timeframe takes into account the estimated time required for Mautassin to process the order. It is not binding; however, in the event of an unusual delay, an email will be sent to the Buyer.

Average shipping times are between 24 to 48 business hours within Morocco and between 4 to 8 business days internationally. Additional time may be required for requested alterations (if any), in addition to the delivery time by the carrier to the shipping address.

In practice, orders are shipped from Mautassin Casablanca, Monday through Friday. Orders placed on Friday evening, Saturday, or Sunday are processed on Monday morning.

Mautassin is not responsible for any non-delivery resulting from errors made by the user in entering their information.

 

5.2. Order Shipment

Once the order is shipped, the Buyer will receive an email including the tracking number of the package. The Buyer can track the delivery by clicking on the tracking link provided. Products are shipped to the delivery address indicated in the Buyer’s customer account. If multiple delivery addresses are saved, the Buyer may select one before confirming and paying for the order. Mautassin does not deliver to P.O. boxes.

The delivery date is provided for informational purposes only. Any reasonable delay not caused by Mautassin or duly justified by it will not entitle the customer to compensation or order cancellation.

 

5.3. Delivery

Mautassin delivers throughout Morocco and internationally, with a package tracking number (see Article 5.2 above).

Packages are generally delivered within 2 to 3 business days in Morocco and 6 to 8 business days outside Morocco, depending on the shipping date. If the Buyer is not present at the time of delivery, the carrier will attempt a second (and final) delivery.

If the Buyer fails to retrieve their package within Moroccan territory, it will be returned to Mautassin’s warehouse. Mautassin will then offer to reship the order. If the Buyer does not respond within 24 hours, Mautassin reserves the right to put the items back on sale and issue a store credit in the Buyer’s name. This credit must be used within a maximum of 3 months from the purchase date, outside of sale periods and before the next season.

 

5.4. Lost/Damaged Packages

If the Buyer does not receive their package, or a delivery notice, or any tracking update within 5 business days following shipment, they must contact Mautassin’s Customer Service at: 📧 mautassin.hautecouture@gmail.com – info@mautassin.com

Customer Service will then open an investigation with the carrier. The Buyer will be notified by email that a postal investigation has been launched, and response times may vary between 10 and 30 days from the start of the investigation. If the package is found, it will be immediately reshipped to the Buyer. If it is declared lost or damaged, Mautassin’s liability will be strictly limited to the value of the lost or damaged goods, and a full refund will be issued to the Buyer.

 

5.5. Shipping Fees

Shipping fees are covered by Mautassin within Moroccan territory.

For deliveries outside Morocco, shipping costs are the responsibility of the Buyer.

 

5.6. Taxes and Charges

For customers outside Morocco, we ship orders excluding import fees. This means that customs duties are not included in the online prices, and you may be required to pay import taxes when receiving your order or later, depending on your country’s regulations. You may also be subject to VAT or sales tax, as well as other potential local charges in order to receive your shipment.

 

Article 6. Exchanges

Exchange Policy at Mautassin

Restrictions on customized items: Mautassin cannot exchange any item that has been personalized, altered, or embellished in any way.

Exchange process for other products: Buyers may request an exchange for all or part of the products purchased within Moroccan territory, provided that the items have not been modified in any way. To initiate an exchange, the buyer must contact Mautassin’s Customer Service by email on the same day the product is received. After this period, the exchange request will no longer be eligible.

Return authorization: A return authorization will be issued by Customer Service the following morning, including the return address for the parcel. The package must be returned on the same day the return authorization is received. Any delay in returning the item may result in the exchange request being declined.

Exchange conditions: The exchange may involve a change of size or color, depending on stock availability at the time of the request, or may result in a store credit valid for three months from the purchase date, excluding sale periods and prior to the next season.

Product conditions for exchange:

  • The item must be returned in its original packaging.
  • It must be unworn, unsoiled, and unwashed.
  • It must be folded and returned with all original security and identification tags intact.

Return responsibility and fees: Return shipping costs and associated risks are the responsibility of the buyer. If an item is lost during return shipping, the buyer assumes full responsibility and will not be refunded. Returned items that are incomplete, damaged, soiled, unfit for resale, or missing original tags will not be accepted for exchange.

Identification of the returned package: A returned package without clear identification, particularly without a return number, will not be accepted. Any claim made after the specified period will be rejected, and Mautassin will be released from any responsibility.

Procedure after receiving the return: If all conditions are met, Mautassin will proceed with the exchange or issue store credit within ten days of receiving the returned item. Reshipping costs will be covered by Mautassin.

Restrictions: Promotional or discounted items are neither exchangeable nor refundable.

Shipping delays for replacement products: Shipping times for replacement items follow the same process as a standard order, as outlined in Article 5.

Article 8: Protection of Personal Data

8.1. Personal Information

 

Providing personal information collected as part of the distance selling process is mandatory, as this data is necessary for registering, processing, and delivering orders, as well as for generating invoices. This information is strictly confidential. Failure to provide such data will result in the automatic rejection of the order.

The User has the right to access, modify, correct, or delete their personal data. To exercise this right, the User must send an email to Mautassin’s Customer Service at the following address: mautassin.hautecouture@gmail.com – info@mautassin.com

In all cases, the User must include their full name, postal address, and, if applicable, their Buyer number.

Lastly, Mautassin may be required to share personal information with its business partners. As a result, the User may receive commercial offers from third parties. It is specified that unless explicitly refused by the User, their postal information may be shared with Mautassin’s commercial partners. However, their email address will only be shared with such partners if the User gives express consent. Naturally, the User may opt out of such communication either by not giving consent during registration and/or order confirmation or by later expressing their refusal by email, in accordance with the procedure described above.

8.2. Cookies

The only cookies created by Mautassin are session cookies, which are automatically deleted when the user logs out of the site.

 

Article 9: Liability

 

Mautassin’s liability is strictly limited to the amount of the Buyer’s order.

Mautassin cannot be held responsible for any inconveniences or damages inherent to the use of a computer, a computer network, or the Internet.

In particular, Mautassin shall not be held liable for any service interruptions, external intrusions, or the presence of computer viruses.

For all stages of accessing the Site—including browsing, form completion, order placement, payment, and any other service available on the Site—Mautassin is only bound by an obligation of means.

 

Article 10: Intellectual Property

 

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark, or patent law. They are the exclusive property of Mautassin.

The content of the website Mautassin.com is the intellectual and exclusive property of Mautassin.

Users of the site are under no circumstances authorized to reproduce or use the content of the website Mautassin.com for their own purposes.

The trademarks of Mautassin and its partners, as well as the logos displayed on the site, are registered trademarks.

Any total or partial reproduction of these trademarks or logos using elements from the Site without the express permission of Mautassin is strictly prohibited under intellectual property law.

No user or visitor of the Site may create a hyperlink to it without Mautassin’s prior and express authorization.

Mautassin cannot be held responsible for any access by the User to other resources on the Internet via hyperlinks present on the Site.

 

Article 11: Duration

These terms and conditions apply for the entire duration during which the Products are made available online by Mautassin.

 

Article 12: Miscellaneous Provisions

12.1. Partial Invalidity

 

If one or more provisions of these General Terms and Conditions of Sale are found to be invalid or declared as such by law, regulation, or final decision of a competent court, the remaining provisions will retain their full force and effect.

 

12.2. Entire Agreement

These General Terms and Conditions of Sale and the order summary sent to the Buyer constitute a contractual whole and represent the entirety of the contractual relationship between the Parties. In case of contradiction between these documents, the General Terms and Conditions of Sale shall prevail.

 

12.3. Force Majeure

Mautassin shall not be held liable for the total or partial non-performance of its obligations under this contract if such non-performance is caused by an event of force majeure, including but not limited to full or partial strikes of postal services, transportation or communication systems, floods, or fires.

In the event of force majeure, Mautassin will notify the User/Buyer within five (5) working days of the occurrence or threat of such event.

The Parties agree to consult with each other as soon as possible to determine the terms of order execution during the period of force majeure.

If the interruption caused by the force majeure exceeds one (1) month, Mautassin reserves the right not to fulfill the order and will refund the Buyer, if applicable, within thirty (30) days.

 

Article 13. Applicable Law – Competent Jurisdictions

These terms and conditions are governed by Moroccan law.

The information collected on the official Mautassin website is specifically intended to apply to one of our products, such as payment and delivery.

Access to this data is limited to individuals who need to know your data due to their role or function.

In accordance with Law No. 09-08 of February 18, 2009, relating to the protection of individuals with regard to the processing of personal data, you have the right to access and rectify information concerning you.

Pursuant to the provisions of Article 202 of Law No. 31/08, in case of a dispute between the supplier and the consumer, the competent court shall be either the court of the consumer’s domicile or residence, or the court of the place where the act causing the damage was committed.
